Is Human Perfection Not Imperfect And Corrupt Minus Rule Of Law?

By Balbir Singh Sooch-Sikh Vichar Manch

First is to decide-make a decision, come to a decision, make your mind up, resolve; end something clearly, ‘to bring something to an end in a definite or obvious way’ and analysis independently, ‘whether human perfection is not imperfect and corrupt minus ‘Rule Of Law’ or What is imperfect and corrupt human minus of ‘Rule Of Law’?

Human nature of people; relating to, involving, or characteristic of human beings; slightly below standard level- ‘used in grading or evaluating something to show that it is slightly below the average standard indicated by a particular symbol-perfection i.e. ‘Rule of Law’.

“Legislator Simarjit Singh Bains of the Lok Insaaf Party, an AAP ally, today, on November 27, 2017 released an audio-tape to “prove a plot” against Punjab’s Leader of Opposition (LIP) and AAP MLA Sukhpal Singh Khaira, who has been summoned by a Fazilka court for questioning on his alleged links with drug smugglers”.

Legislator Simarjit Singh Bains and his Legislator brother Balwinder Singh released a 17-minute recording in which former Deputy Advocate General Amit Chaudhary purportedly tells former PCS officer TK Goel that Rs 35 lakh had been paid to a judge to ensure that Khaira’s review petition in the High Court, that the charges against him be quashed, was dismissed.

Chaudhary, claiming he had received the ‘text’ of the court order a day before it was pronounced, is heard saying it had been pre-decided that non-bailable warrants against Khaira would be cancelled but his review petition in the High Court dismissed.

Legislator Simarjit Singh Bains said he would submit a video-recording of the Chaudhary-Goel meeting and “reveal the date, time, place of the conversation” either to the CBI (A “caged parrot” – Supreme Court describes CBI) or the High Court.
Chief Minister Capt Amarinder Singh refused to be drawn into the controversy. Asked if he would order a CBI inquiry as sought, he replied: “Let courts decide the matter.” Courtesy: The Tribune, Chandigarh

As to why Legislator Simarjit Singh Bains and his Legislator Balwinder Singh talks about some independent body like CBI or the High Court and similarly Chief Minister Captain Amarinder Singh refused to be drawn into the controversy… as sought, he replied: “Let courts decide the matter?”

Do here the High Court and courts decide the matter, does not mean, ‘Rule of Law’?

Because here human nature of people involved is slightly below the average standard indicated by a particular symbol-perfection i.e. ‘Rule of Law’ and obviously inference can be drawn only to that effect under the prevailing circumstances in India. Is it wrong to say so?

Again question arises here that human nature of people (generalized) is not perfect and pure minus ‘Rule Of Law’ but human nature of people (generalized) is imperfect and corrupt minus of ‘Rule Of Law’ generally?

It is practiced, experienced by social, political thinkers etc especially by the political thinker, ‘PLATO’ after lengthy process and experience to replace law with his ‘Philosopher King’, but and finally by the political thinker, ‘PLATO’ and his ‘Philosopher King’ (Philosopher king, idea according to which the best form of government is that in which philosophers rule: Courtesy ENCYCLOPEDIA BRITANNICA) proved as failure due to imperfection of his ‘Philosopher King’ being human for number of reasons, thus human is slightly below the average standard indicated by a particular symbol-perfection i.e. ‘Rule of Law’. After his the failure at the end, the political thinker, ‘PLATO’ advocated and wrote for only to adopt ‘Rule of Law’ to check the imperfection of human nature of people always.

Thus the role of judiciary can’t be underestimated and replaced with those elected to govern. Although upright legislators-law makers should support the judiciary taking it forward towards further perfection with the help of independent investigating agencies as the upright lawyers are supposed to assist the courts to be perfect for delivering the justice to all victims impartially.

But here again imperfection of human nature of people including legislators, investigating agencies and lawyers all over is becoming hindrance in delivering justice as per ‘Rule Of Law’ especially in the corrupt system of India. Isn’t?

Our learned Union Law Minister Ravi Shankar Prasad said on Sunday, on November 26, 2017 that at the core of the verdict is the judiciary’s distrust in the capability of the Law Minister and the Prime Minister to appoint a “fair judge” seems find and try to say that the human perfection is perfectly within the Law Minister and the Prime Minister of India (Elected democratically though by immature questionable democracy as being seen now) as to why all Indians don’t trust them?

Does it mean nothing related to law and judiciary required to exist as long as like them, the Law Minister and the Prime Minister of India are available now with Indians?

Or
Our learned Union Law Minister Ravi Shankar Prasad must have said so sarcastically-mockingly and habitually- to treat somebody or something with scorn or contempt in the context. Who knows?

The author this note, like to quote here his recent comment, ‘Political Revolution in India Has Begun. Bharat Jaldi Badlega’: Sycophancy Game: Congress –BJP: Dummy Election War in India under the Garb of UPA versus NDA: Deceivingly-Dishonestly, Misleadingly Sponsored-‘somebody who answers on behalf of a child at baptism and becomes responsible for the child’s religiously and politically upbringing’ by the Indian Agencies Traditionally Nothing Else in India So Far!

Submission: Reform Hollow-Worthless, Flattery- Sycophancy and Dummy-Fake System of India. Political Revolution in India Has Begun. Bharat Jaldi Badlega: Arvind Kejriwal Said as the author of this note, Balbir Singh Sooch is also observing.

Hence, the ‘Rule of Law’ has to prevail over the imperfect human nature of people through the upright judiciary and the governance “must not remain” with ‘those elected to govern’ absolutely, in the larger interest of justice, as being demanded and stressed presently in India.
